48 hours to go: LKP advice on responding to the Law Commission consultation on commonhold

Consultation on the Law Commission report on commonhold ends on Sunday at mid-night.

Please make sure you make a contribution. Question 94 is pretty open-ended, where leaseholders can say why they think a commonhold structure would be an improvement on current leasehold.

The bulk of the Law Commission consultation is concerned with making commonhold work vis-à-vis existing leasehold and converting this stock to commonhold.

What LKP argues for is the altogether much simpler point: stop developers creating leasehold with wealth eroding investment vehicles in ordinary families’ homes.

Commonhold needs to become mandatory for new build. After that, the conversion to commonhold of existing stock becomes a pressing issue.

Key to this is the ending of ground rents. Once this legally enforceable income stream, for no designated service, is removed, the case against commonhold falls apart and England and Wales join the rest of the world.
