New Estate Management thrown out of Property Ombudsman for not paying £1,000 award

February 10, 2023 //  by Sebastian O'Kelly//  4 Comments

Nottingham-based property management company New Estate Management, run by Adam New, has been expelled from the Property Ombudsman Scheme for the non-payment of an award of £1,000.

The decision was taken in July last year.

In spite of this, Mr New’s website still (10 February 2023) retains the Property Ombudsman logo, along with that of the Institute of Residential Property Management.

The Property Ombudsman Scheme (TPOS), which has instructed Mr New to remove the logo, had found nine failings that included failing to inform leaseholders that cleaning services would be carried out by themselves, the standard of work undertaken to the basement corridor and a breach of management agreement.

The issue was raised with LKP by leaseholders who are shareholders of the The Malthouse (Horninglow) Management Company Limited, which manages 39 leasehold flats in Burton-on-Trent, DE14 1DJ.

The leaseholders were upset that the company, of which New Estate Management acts as company secretary, had a compulsory strike-off against it, which has now (2 February 2023) been removed.

New Estate Management appears to be a one-man band with assets of c£6,000.

The IRPM, now joined with ARMA in The Property Institute, has been copied into all the relevant correspondence.

Y&Y Management is a member of the Property Ombudsman https://www.yymanagement.co.uk/YY-Complaints-procedure.pdf

It is also, we believe, still a member of ARMA.

Similer situation with failure of the ARHM Code of Practice.
Members of the Association of Retirement Home Managers keenly promote the ARHM logo but stubornly and extensively refuse to follow the ARHM Code of Practice.

This company is run by a devious person, the decision to expell his shambolic company is a good one and will protect other vulnerable leaseholders. Looking through companies House records it seems they have lost a lot of business recently.
