Commonhold is common sense: response to Charles Russell Speechlys propagandising for leasehold in CityAM

March 28, 2019 //  by Sebastian O'Kelly

CityAM, the freesheet London morning newspaper, today published LKP’s response to an article earlier in the week by solicitors at Charles Russell Speechlys.

The solicitors, who come in pairs (which may be an indication of the content), were gigging through the usual nonsense about commonhold tenure: “be careful what you wish for”; “babies and bathwater”; “cows no longer yielding milk etc …”

Some of these are made up, but you get the picture, and you can read the full piece here:

It seems these solicitors were paid by “third -party landlords” to spread some ” untrue claims ” :

They said ” In contrast, commonhold is largely untested, as well as being unappealing to developers and purchasers alike in its current form. But more fundamentally, the removal of a third-party landlord will not exclude the possibility of an antagonistic relationship between those responsible for running the building and those who are paying the costs.

The commonhold system relies on homeowners having the desire, time, and skills to take an active role in the management of their communal facilities. This simply cannot be guaranteed”

The French Revolution in 1789 against the King and his Royalist backers , started the dismantling of the leasehold estates previously owned by French Royalty giving way to the Commonhold property ownership by the common people. Subsequently, the rise of Emperor Napoleon and his armies into other countries led to most of Europe adopting Commonhold. property system.

Commonhold has been around for nearly 300 years in Europe , so it has been proven tested and they have not gone back to Leasehold system. Around 1805, the Royal Navy managed to defeat the French & Spanish naval fleets and prevent invasion by Napoleon . Consequently in England cars drive on the left side of the road whilst in Europe , cars drive on the right side of the road.

LKP should make a complaint to the SRA against those solicitors for making untrue public statements to subvert the minds of the public and press..

Driving cars on left side of road in E & W is not a hardship but having 4 million leaseholders in E & W is economically damaging for our country.

Some 4 million leaseholders have got their savings tied up in “leasehold property” is a debt burden valued at 4 Mil x £200,000 per leasehold unit = £ 800 Billion total . Does it make sense to continue using the leasehold system of home ownership ?

This debt burden ( at nearly 50% of the National Debt ) would not exist if the properties were sold under Commonhold title or 999 years leasehold title at NIL ground rent .
